Tobacco and Vapour Product Sale Offences
The Northwestern Health Unit enforces the Smoke-Free Ontario Act, 2017 (SFOA, 2017) to help reduce youth access to tobacco and vapour products and ensure specified public places and workplaces are smoke and vapour-free. The SFOA, 2017 prohibits the sale or supply of tobacco and vapour products to anyone under the age of 19 in Ontario, or to anyone who appears to be younger than 25 years old unless identification is provided.

Tobacco retailer sales convictions
If a tobacco retailer receives two or more related convictions, they may receive an automatic prohibition, which prevents them from selling tobacco products for a designated period.

Automatic Prohibition convictions
An Automatic Prohibition prevents a business from the sale, storage, and delivery of tobacco products for a minimum of six months. Certain tobacco sales offences that result in a conviction can be applied towards an Automatic Prohibition. A location is subject to an Automatic Prohibition when two or more owner convictions for tobacco sales offences occur within a five-year period, regardless of a change in ownership.
